Car Rental Agreement
VEHICLE RENTAL AGREEMENT
This Vehicle Rental Agreement (“Agreement”) is concluded between trabzonotokiralama.com (“Lessor”) and the Lessee whose information is provided below, as an integral part of the Vehicle Delivery Form.
By signing this agreement, the Lessee accepts and undertakes to use the vehicle in accordance with the terms of the agreement and to pay the rental fee and all incidental expenses on time.
1. NOTICE ADDRESS
The address declared by the Lessee in the agreement is the legal notice address. Unless a change of address is notified in writing, notices made to this address shall be deemed valid.
2. CONDITION OF THE VEHICLE UPON DELIVERY
The Lessee accepts that they have received the vehicle in good mechanical and bodywork condition, operational and in good order.
All existing damages at the time of delivery are specified in the Vehicle Delivery Form. If damages not specified in the form are detected during return, it is accepted that the damage was caused by the Lessee.
3. DELIVERY – RETURN OBLIGATIONS
The vehicle; together with the registration, key, spare tire, and all equipment, shall be returned to the station where it was received or to the place specified in the agreement.
Additional services such as baby seats, navigation, etc., are charged separately.
4. LIABILITY ARISING FROM USE
All direct and indirect damages caused by the Lessee's fault, negligence, or misuse and not covered by insurance belong to the Lessee.
5. AGE – LICENSE REQUIREMENT AND ADDITIONAL DRIVER

Economy group: 24 years old / 4 years license

Middle group: 26 years old / 5 years license

Upper group: 28 years old / 6 years license
Additional drivers must be notified in writing to the Lessor and added to the agreement. Otherwise, all responsibility lies with the Lessee.
6. RENTAL PERIOD AND FEES

Minimum rental period is 24 hours

Delay up to 3 hours: Hourly rate

Delay over 3 hours: 1 full day
The Lessee is also obligated to pay;

One-way fee
-
Missing fuel + 25% service fee
-
Highway, parking, HGS/OGS tolls, and traffic fines.
7. PAYMENT AND PROVISION
Payments are made at the beginning of the rental.
A pre-authorization (provision) is taken from the credit card.
The Lessee agrees not to object to the collection of traffic fines, illegal toll crossings, and damage costs from the provision.
8. EXTENSION OF PERIOD
Extension of the period is possible only with the Lessor's approval. Vehicle use cannot continue without approval.
9. TRAFFIC RULES AND FINES
All traffic fines belong to the Lessee.
Fines paid by the Lessor will be collected from the Lessee by adding a service fee.
10. PROHIBITED USES
The vehicle;

Cannot be rented to others

Cannot be used in races, rallies, or for transporting goods or passengers

Cannot be used in illegal activities
-
Cannot be used by taking it abroad
Otherwise, the agreement shall be terminated immediately.
11. INSURANCE AND DAMAGE LIABILITY
The insurance is invalid and all damage belongs to the Lessee in the following cases:

Under the influence of alcohol / drugs
-
Speeding violations
-
Failure to obtain an accident report
-
Use by an unauthorized driver
-
Circumstances outside the scope of insurance
12. OBLIGATIONS IN CASE OF ACCIDENT
The Lessee is obliged to;

Ensure safety
-
Obtain reports and documents
-
Take photographs
-
Notify the Lessor within 24 hours
13. THEFT AND SECURITY
The vehicle must be parked locked.
Theft coverage is not valid unless the key and registration are delivered.
14. THIRD PARTY DAMAGES
All damages exceeding the mandatory traffic insurance limits belong to the Lessee.
15. LIABILITY FOR BELONGINGS
The Lessor is not responsible for belongings left in the vehicle.
16. MECHANICAL RESPONSIBILITY
The Lessor's responsibility is limited to delivering the vehicle maintained and ready for use.
17. BREACH OF AGREEMENT
If the vehicle is not returned on time, the Lessor has the right to repossess the vehicle from wherever it is located.
18. VEHICLE TRACKING SYSTEM
The vehicles are equipped with a GPS tracking system.
The Lessee accepts the use of the system and cannot interfere with it.
19. EXPENSES AND EVIDENCE AGREEMENT
All expenses belong to the Lessee.
The records of the parties shall constitute conclusive evidence (CCP Art. 193).
20. AUTHORIZED COURT
In case of disputes, Trabzon Courts and Enforcement Offices are authorized.
